These Terms and Conditions (“Terms”) govern your subscription to and use of the broadband, internet, and bundled OTT and television services provided by Digital Fiber Tech Private Limited (“Digital Fiber”, “the Company”, “we”, “us” or “our”). This document is an electronic record under the Information Technology Act, 2000 and does not require any physical or digital signature.

Please read these Terms carefully. By submitting a Customer Application Form (CAF), subscribing to, activating, paying for or using any of our Services, you confirm that you have read, understood and agree to be bound by these Terms, together with our Privacy Policy, the CAF, the applicable plan/tariff details, and any Acceptable Use Policy or service-specific terms. If you do not agree, please do not subscribe to or use the Services.

1. Definitions

  • “Company” / “We” / “Us” / “Our” means Digital Fiber Tech Private Limited, including its affiliates, successors and permitted assigns.
  • “Customer” / “Subscriber” / “You” means any person or entity who applies for, subscribes to, or uses the Services.
  • “Services” means the fibre-optic broadband and internet access services, and any bundled or add-on over-the-top (“OTT”), IPTV/digital television, value-added and related services we provide.
  • “CAF” means the Customer Application Form (physical or digital) completed by you when applying for the Services.
  • “CPE” / “Equipment” means the customer-premises equipment provided by us, including the optical network terminal/unit (ONT/ONU), router, set-top box and accessories.
  • “Plan” / “Tariff” means the package of speed, validity, price and features you select, as published by us and as governed by applicable TRAI/DoT regulations.
  • “FUP” means the Fair Usage Policy applicable to a Plan, where notified.
  • “Site” means our website www.digitalfiber.in and our official applications.

2. Acceptance and Scope of Agreement

These Terms, read together with the CAF, the Privacy Policy, the applicable Plan/tariff, and any Acceptable Use Policy or service-specific terms, constitute the entire agreement between you and the Company in respect of the Services. In the event of a conflict, the order of precedence shall be: applicable law and regulatory directions, followed by the CAF, followed by these Terms, followed by other published policies, unless stated otherwise. Your continued use of the Services after any update to these Terms constitutes acceptance of the updated Terms.

3. Eligibility, Application and KYC

  • You must be at least 18 years of age and competent to contract under Indian law to subscribe to the Services.
  • You agree to provide true, accurate, current and complete information in your CAF and to keep it updated.
  • As required under applicable telecom licensing and Know-Your-Customer (KYC) norms, you must submit valid proof of identity and address (such as Aadhaar, PAN, Passport, Voter ID or Driving Licence) before activation. We reserve the right to verify your information at any time and to reject, suspend or terminate an application or connection if any information is found to be false, incomplete or misleading.
  • Residential/home Plans are intended for personal, non-commercial use only. Commercial use, resale or redistribution of the Services on a home Plan is not permitted.

4. Provision and Installation of Services

  • Provision of the Services is subject to technical feasibility and serviceability at your premises. Any timelines indicated for installation or activation are indicative only.
  • Installation and other one-time charges, where applicable, are as published in the relevant Plan and are non-refundable.
  • You are responsible for providing safe access to your premises, adequate space, a power supply, and any cabling pathways/conduits required for installation. Obtaining permissions from your landlord, building or housing society for installation and right of way is your responsibility.
  • The Services are deemed activated upon successful installation and receipt of applicable charges.

5. Customer-Premises Equipment (CPE)

  • Unless expressly sold to you, all CPE (including the ONT/ONU and router) provided on a “free-to-use”, rental or security-deposit basis remains the property of the Company at all times, and must be returned to a person/agent designated by us upon termination, surrender or deactivation of the Services.
  • Where a refundable security deposit is collected against CPE, it will be governed by Section 8.
  • You must keep the CPE safe and in good condition, and must not tamper with, open, modify, relocate or connect it to unauthorised networks. You bear the risk of loss of or damage to the CPE while it is in your custody.
  • Faulty CPE will be repaired or replaced by us within the timeframe notified for your Plan, subject to inspection. CPE that is lost or damaged due to misuse, negligence or causes other than normal wear and tear may attract a replacement/recovery charge of ₹[insert amount].

6. Plans, Tariffs, Billing and Payment

  • The Services are offered on a prepaid/advance-payment basis. Charges for a Plan must be paid in advance, and, being prepaid, are non-refundable except as expressly provided in Section 8.
  • All charges are exclusive of GST and other applicable taxes/levies, which are payable in addition to the Plan charges.
  • Plans, tariffs and offers are as published by us and are subject to the guidelines, directions and orders issued by the Telecom Regulatory Authority of India (TRAI) and/or the Department of Telecommunications (DoT). We reserve the right to revise, modify, introduce or withdraw Plans, tariffs and offers in accordance with applicable regulations.
  • Promotional or introductory Plans are valid for a limited period, may be withdrawn at any time, are one-time onboarding offers, and may not be available on renewal. Prices may vary by location and may differ on renewal.
  • Non-payment of applicable charges by the due date may result in suspension or termination of the Services. Reconnection may be subject to additional charges.

7. Fair Usage Policy and Service Speed

  • Plan speeds are provided on a best-effort, “up to” basis and are committed up to the LAN/Ethernet port of the CPE. Wi-Fi speeds within your premises depend on factors such as in-house coverage, walls/obstructions, the number of connected devices and the performance of your devices, and may be lower than the Plan speed.
  • A Fair Usage Policy may apply to certain Plans. Where notified, FUP forms an integral part of these Terms, and data speeds may be moderated after the applicable usage threshold is reached.
  • We may carry out reasonable network management to maintain service quality, security and regulatory compliance.

8. Refunds and Security Deposit

  • As the Services are prepaid, Plan charges, installation charges and other one-time charges are non-refundable. A refund of the first payment may be considered only where a new connection cannot be provided due to non-feasibility at your address.
  • Where a refundable, interest-free security deposit is collected against CPE, it will be refunded only after the CPE is returned to our designated agent in proper working condition (subject to reasonable wear and tear) and you have no outstanding dues. Refunds will be processed within [insert number] working days of acceptance of the returned CPE.
  • Refunds are made online only, to the bank account/UPI registered with us at the time of registration. Refunds will not be made in cash or by cheque, or to any other account.
  • If you do not renew or otherwise fail to maintain an active subscription for a continuous period exceeding [insert number, e.g., six (6)] months, the security deposit may stand forfeited. We may, but are not obliged to, attempt to notify you before such forfeiture; failure to notify will not affect our rights. We may still facilitate collection of the CPE, but this does not entitle you to any refund of a forfeited deposit.

9. Acceptable Use of the Services

You agree to use the Services lawfully and in compliance with all applicable laws, including the Information Technology Act, 2000 and the rules thereunder, and the Telecommunications Act, 2023. You must not use the Services to:

  • host, display, upload, transmit or share any content that is unlawful, obscene, pornographic, paedophilic, defamatory, harassing, hateful, or that infringes any intellectual property or other rights of any person;
  • harm minors in any way, or distribute content that threatens the unity, integrity, defence, security or sovereignty of India, public order, or friendly relations with foreign states;
  • engage in hacking, unauthorised access, network probing or scanning, distribution of viruses or malware, denial-of-service activity, or any attempt to compromise the security or integrity of any network or system;
  • send spam or unsolicited bulk communications, engage in unauthorised telemarketing, or carry out any commercial use, resale or redistribution of the Services on a residential Plan;
  • engage in any fraudulent, abusive or illegal activity, or any activity that interferes with or degrades the Services or the network for other users.

We reserve the right to suspend or terminate the Services, with or without notice, and to cooperate with and disclose information to law-enforcement and regulatory authorities, in the event of any actual or suspected violation of this Section.

10. OTT and Television (Bundled) Services

  • Bundled OTT applications and television content (such as Prime Video, JioHotstar, ZEE5, Sun NXT, aha and ETV Win) are owned and operated by independent third parties and are governed by their own terms of use and privacy policies.
  • Where bundled, the OTT/TV subscription period is generally co-terminus with the validity of your broadband Plan; activation and expiry dates may vary across platforms. Subscriptions are typically activated once per Customer on the mobile number registered with us, are non-transferable, and carry no cash or alternative redemption value.
  • We are not responsible for the content, availability, configuration, streaming quality or functionality of any OTT/TV platform. For any issue concerning OTT/TV content or access, please contact the customer support of the relevant platform. No refund will be provided for dissatisfaction with, or non-use of, any bundled OTT/TV service, and any unutilised benefit is forfeited on expiry of the Plan.
  • We may modify, restrict to particular locations, or withdraw any bundled OTT/TV offer at any time owing to business or regulatory (TRAI/DoT) considerations. To activate certain services, we may share the minimum necessary subscriber information (such as your registered mobile number) with the relevant partner.
  • All third-party names, logos and marks are the property of their respective owners and are used in a limited manner only to identify the services included in a Plan.

11. Service Availability, Maintenance and Force Majeure

The Services are provided on a best-effort basis. We do not warrant that the Services will be uninterrupted, error-free or available at all times. The Services may be temporarily unavailable due to scheduled or emergency maintenance, upgrades, network congestion, last-mile constraints, power failures, equipment faults, or events beyond our reasonable control (“force majeure”), including natural disasters, fire, flood, strikes, civil unrest, acts of government or regulatory direction. We shall not be liable for any interruption, suspension or degradation of the Services arising from such causes.

12. Your Obligations

  • Provide and maintain accurate account information and promptly notify us of any change (including relocation).
  • Keep your account credentials and Wi-Fi password confidential and secure, and promptly notify us of any unauthorised use or security breach.
  • Use the Services and CPE lawfully and only as permitted under these Terms, and not share, sublicense or resell the Services.
  • Provide reasonable access to your premises for installation, maintenance and recovery of CPE.
  • Pay all applicable charges and dues on time.

13. Connection Shifting / Relocation

Relocation of your connection to a new address is subject to technical feasibility at the new address. A shifting request may be initiated through our app or Customer Care and may attract a one-time charge of ₹[insert amount] (inclusive of taxes). If shifting is not feasible at the new address, the request may be cancelled and no refund will be due for any non-feasible request.

14. Suspension, Termination and Disconnection

  • By you: You may request disconnection by giving notice through our Customer Care, returning the CPE and clearing all outstanding dues.
  • By us: We may suspend or terminate the Services, with or without notice as appropriate, in the event of non-payment, breach of these Terms or the Acceptable Use Policy, unlawful or fraudulent use, submission of false information, or pursuant to any regulatory or legal direction.
  • Effect of termination: Upon termination, your right to use the Services ceases, all outstanding dues become payable, and you must return the CPE. Any refundable security deposit will be dealt with in accordance with Section 8. Reconnection, where permitted, may be subject to fresh charges.

15. Intellectual Property

All intellectual property rights in the Services, the Site, the “Digital Fiber” name and logo, software, designs, graphics and content are owned by or licensed to the Company. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to use the Services for their intended purpose. You may not copy, reproduce, modify, distribute, reverse-engineer or create derivative works from any part of the Services or the Site without our prior written consent. Third-party marks (including OTT/TV platform marks) remain the property of their respective owners.

16. Disclaimers and No Warranty

The Services and the Site are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy, completeness or reliability of information. Any reliance you place on information made available through the Site is at your own risk. Online payments are processed through third-party payment gateways subject to their own terms; we are not responsible for any error, failure or fraud occurring at the payment gateway or arising from misuse of your payment instrument or credentials.

17. Limitation of Liability

To the fullest extent permitted by law, the Company (including its affiliates, directors, officers, employees and agents) shall not be liable for any indirect, incidental, special, punitive or consequential damages, or for any loss of profit, data, goodwill or business, arising out of or in connection with the Services or the Site, whether based on contract, tort or otherwise. In any event, the Company’s aggregate liability shall not exceed the charges actually paid by you for the relevant Service during the [insert period, e.g., three (3) months] immediately preceding the event giving rise to the claim.

18. Indemnity

You agree to indemnify and hold harmless the Company and its affiliates, directors, officers, employees and agents from and against any and all claims, losses, liabilities, damages, costs and expenses (including reasonable legal fees) arising out of or relating to your breach of these Terms or the Acceptable Use Policy, your violation of any applicable law, your infringement of any intellectual property or other rights, or your misuse of the Services. This obligation survives termination of your relationship with the Company.

19. Lawful Interception and Regulatory Compliance

As a licensed/registered provider of internet and telecommunication services, we are obliged under the Telecommunications Act, 2023, the Information Technology Act, 2000 (including Section 69), and our licence/registration conditions to verify subscriber identity, retain prescribed records, and provide assistance and access to authorised government and law-enforcement agencies for lawful interception, monitoring and security purposes. We comply with such lawful requirements. Personal data is otherwise handled in accordance with our Privacy Policy.

20. Privacy

Your personal data is collected, used, shared and protected in accordance with our Privacy Policy, available at www.digitalfiber.in, which forms part of these Terms.

21. Grievance Redressal and Customer Care

We are committed to resolving your concerns promptly. Complaints may be raised through the following escalation levels:

For grievances relating to content or information under the Information Technology (Intermediary Guidelines) rules, or relating to personal data under the Digital Personal Data Protection Act, 2023, you may contact our Grievance Officer at contact@digitalfiber.in. We will endeavour to acknowledge and resolve complaints within the timelines prescribed under applicable law.

22. Changes to Terms, Plans and Services

We may amend these Terms, and may modify, introduce or withdraw Plans, tariffs, offers, features or the Services, in accordance with applicable laws and regulatory requirements. Updated Terms will be published on the Site with a revised “Last updated” date and will take effect from the date of publication. Your continued use of the Services after such changes constitutes acceptance. In the event of any conflict between these Terms and any applicable law or direction of the Government, DoT, TRAI or other competent authority, such law or direction shall prevail.

23. General

  • Entire agreement: These Terms, together with the documents referred to herein, constitute the entire agreement between you and the Company regarding the Services.
  • Severability: If any provision is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
  • Waiver: Our failure to enforce any provision shall not constitute a waiver of that or any other provision.
  • Assignment: We may assign our rights and obligations under these Terms. You may not assign yours without our prior written consent.
  • Notices: We may send you notices by SMS, email, app notification or by posting on the Site.

24. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of India. Subject to applicable law and any applicable telecom/consumer dispute-resolution mechanism, the courts at Hyderabad / Rangareddy, Telangana shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms.
